NEW DELHI: Article 370, which gives Jammu & Kashmir unique status, will be withdrawn this morning in parliament, Home Minister Amit Shah said. The announcement came after his cabinet meeting at his house this morning was held by Prime Minister Narendra Modi.

  1. Article 370 is a ' temporary provision ' granting special autonomous status to Jammu & Kashmir. It allows the state to draft its own Constitution and restricts the legislative powers of the parliament over the state.
  2. The government therefore requires state government approval for all legislation, except those related to defence, foreign affairs, finance, and communications. Parliament can not also improve or decrease the boundaries of the State under Article 370
  3. As a consequence, citizens of Jammu & Kashmir live under a distinct set of legislation, including those linked to nationality, land ownership, and fundamental rights, as compared to other Indians.
  4. It also confers powers such as the need for "state public competition" if the central government intends to create changes to the concurrent list of topics.
  5. Under Article 370, the center can only declare an emergency in the state in the event of war or external aggression ; this precludes doing so for inner disturbances, unless specifically made at the request of the state government.
